Deceased Patient’s Family Suing for Malpractice

Quebec City (Quebec) August 20, 2014 – A lawsuit has been presented against Hopital L’Enfant Jésus and three of its doctors for the death of a man who was suffering from severe burns but who apparently died from other complications directly caused by a medical error committed by hospital staff.

M. Girard was transferred from a hospital in La Malbaie back in August of 2012, was being fed through a tube and underwent a tracheotomy intervention at L’Enfant Jésus. During the operation the tube was removed but when it was replaced after the operation, according to the patient’s family, the tube was directed to the patient’s lung instead of to his stomach. After three days of suspicion by M. Girard’s wife, an x-ray was taken which according to the doctor in charge showed everything as being perfectly normal. As the symptoms continued a resident doctor finally decided to do a bronchoscope inspection which resulted in the discovery of the misplaced bronchial tube. At this point M. Girard was found to be in a brain-vegetative state which was irreversible. The patient died one month after being transferred to L’Enfant Jésus hospital. The family is suing the hospital and the three doctors who were involved with the case for $475,000 under the pretext of malpractice and negligence, stating that if the particular tube had been properly inserted and or the mistake discovered soon enough, M. Girard may still be alive.

The case will be before the courts on September 20 at the Palais de Justice de Québec.
